If the complaint is deemed valid, we act promptly to remove or restrict access to the material in question. Once the action is taken, we notify the user who posted the allegedly infringing content and inform them of their legal right to respond with a counter-notification, if they believe the removal was a mistake. We are also obligated by law to forward a complete copy of your takedown notice to the user whose content was reported. This includes all contact details you provide, such as your name, address, and email. This level of transparency is necessary to preserve due process under the DMCA and allows the accused party to seek resolution or clarification through the legal counter-process. If you are a copyright owner, or you represent one, and you have identified content on our service that infringes on your rights, you may submit a DMCA takedown request. Your notice must include all the following information: An accurate description of the copyrighted work you believe has been infringed. For multiple works, a list or representative compilation is acceptable. Detailed identification of the infringing content, such as exact URLs, file paths, or other information that enables us to locate the material on our platform. Your full contact information, including your name, physical mailing address, telephone number, and email address. A statement of good faith indicating that the use of the material is not authorized by you, your agent, or applicable copyright law. A declaration that the information in your notice is accurate, and that you are the copyright owner or authorized to act on the owner’s behalf, made under penalty of perjury. Your physical or electronic signature, which serves to confirm the authenticity of the takedown request. Upon receiving and verifying your complaint, we will disable or remove the identified content. Our team will contact the uploader to notify them of the action taken and inform them of their rights under the DMCA. If the affected user believes that the content was wrongly removed or disabled, they have the right to issue a counter-notification, which is a legally recognized response under the DMCA framework. A valid counter-notice must include the following: Identification of the material that was removed and its prior location on our site. The user’s name, physical address, telephone number, and email address. A good faith statement, made under penalty of perjury, that the user believes the content was removed or disabled as a result of mistake or misidentification. A declaration that the user consents to the jurisdiction of the Federal District Court in the district where they reside. If they reside outside of the United States, they must consent to jurisdiction in any district where our company is located. A statement that they will accept service of process from the person who filed the original takedown request or their authorized representative. The user’s electronic or physical signature. Once we receive a valid and complete counter-notification, we will forward it to the original complainant. Unless the complainant initiates a legal action within 10 to 14 business days to restrain the use of the disputed content, we may restore the material in question to our platform. Please be aware that under Section 512(f) of the DMCA, any person who knowingly makes false claims in a takedown or counter-notification may be subject to liability for damages, including court costs and attorney’s fees. Abuse of this system undermines the lawful protections it was designed to offer and may result in serious legal consequences. We strongly recommend that both copyright holders and users act with care, integrity, and an understanding of their legal rights and responsibilities.
